Sculpt3D’s Terms and Conditions outline the process for creating bespoke sculptures from client-provided images or in-person scans. Key terms cover data ownership, payments, cancellations, and production timelines. Refunds are only available for faulty products, and all data is securely stored. Client privacy is respected, and promotional use requires consent. By using our service, clients agree to these terms.
1.1 The company offers two methods for creating virtual models and sculptures:
(a) Client-Provided Data: The client provides the company with videos and photographs following a guide provided by the company.
(b) Company-Performed Survey: Sculpt3D undertakes a survey of the subject to collect the necessary data for producing the virtual model.
1.2 The company uses the provided or collected data to create a point cloud and a virtual model.
1.3 The company may engage a third party to assist in creating the virtual model where doing so is likely to improve the final result. Any third party engaged will be required to sign a confidentiality agreement before receiving any data.
1.4 Any data shared with a third party will be anonymised and will not include identifiable information such as names, addresses, facial features, surroundings, or tattoos.
1.5 All third parties engaged by the company are contracted and paid directly by the company.
2.1 The standard turnaround time for a completed sculpture is 16 weeks from the date of virtual model approval.
2.2 This service includes:
2.3 All communication regarding the commission is strictly between the client and the company.
2.4 Sculptures are produced using 3D printing technology. As an inherent characteristic of this process, surface layer lines may be present on the finished piece. All sculptures are sanded to minimise surface lines to the greatest extent practicable. The surface finish, colour, proportion, and detail accuracy of any sculpture are intended to be assessed at a viewing distance of one metre or greater. The company’s liability in respect of surface finish, colour, proportion, and detail does not extend to characteristics that would not be apparent when the sculpture is viewed from a distance of one metre or greater.
3.1 The client may withdraw from the process at any stage. Fees may apply depending on the stage reached at the time of withdrawal. Please refer to Section 5 for further details.
3.2 All data provided or collected will be stored securely for five years to allow for reproduction if required. After this period, all data will be permanently and securely deleted.
3.3 Where a company-performed survey is undertaken, the client agrees to cooperate with any reasonable requirements of the scanning process, including maintaining a still position and following specific instructions given by the company.
4.1 The client retains ownership of all original materials submitted to the company, including photographs and videos.
4.2 The company retains ownership of all derived works produced during the commission, including but not limited to 3D scans, point clouds, virtual models, and the final physical sculpture.
4.3 The client is granted a non-exclusive licence to use the final sculpture for personal, non-commercial purposes. The client may not reproduce or commercially exploit the sculpture without the company’s prior written consent.
5.1 Pricing is as quoted and invoiced, and may vary depending on the specification and finish of the sculpture.
5.2 A deposit of £100 is required to book an appointment and commission the virtual model. This deposit is non-refundable once virtual model production has commenced. Prior to commencement, the following cancellation terms apply:
5.3 If the client proceeds to sculpture production, the £100 deposit will be deducted from the total quoted amount.
6.1 The company will endeavour to resolve any disputes or issues promptly and to the best of its ability.
6.2 Refunds will not be issued unless the sculpture is found to be faulty. For the purposes of these terms, a fault does not include surface characteristics that fall within the standard described in clause 2.4.
6.3 If a sculpture is found to be faulty, the company will remake the sculpture at no additional cost to the client. The cost of returning the faulty sculpture to the company will be covered by the company.
6.4 Any dispute regarding the condition or quality of a sculpture will require the product to be returned to the company for assessment before any remedy is provided.
7.1 A maximum of three revisions to the virtual model are permitted within the quoted price. Additional revisions beyond this may be subject to a further charge, which will be agreed in writing before work proceeds.
8.1 Sculptures and virtual models will not be used for social media, advertising, or website promotion without explicit prior written consent from the client.
By proceeding with the service, the client confirms they have read and agreed to these Terms and Conditions.
